Terms of Service
These terms are the agreement between you and NEXLY LLC, a limited liability company in the United States that operates AIWritingPal (“we”, “us”). By creating an account or using AIWritingPal, you agree to them. If you do not agree, please do not use the service. Our Privacy Policy explains how we handle your information.
1. The service
AIWritingPal is a full-screen writing editor. Blue Pencil, its AI, suggests edits to text you select, answers questions about your draft (“Ask”), and gives editor notes on a whole draft (“Review”). You decide whether to accept or reject each suggestion. Starter templates can generate a first draft from a brief you provide.
2. Who can use AIWritingPal
You must be at least 13 years old (or 16 in the EEA where local law requires) to use AIWritingPal. To buy a paid plan, you must be legally able to enter into a contract. If you use AIWritingPal on behalf of an organisation, you confirm that you are authorised to accept these terms for it.
3. Your account
Keep your sign-in details secure and accurate. You are responsible for what happens under your account. If you think someone else has accessed it, change your password and let us know at [email protected].
4. Acceptable use
Use AIWritingPal for lawful writing. You agree not to:
- create, store, or share content that is illegal;
- harass, threaten, or abuse others, or use the service to send spam;
- try to break, probe, scrape, overload, or get around the limits or security of the service;
- use the service to infringe other people’s rights, including copyright, trademark, and privacy;
- use the service to produce content meant to deceive, such as submitting AI-assisted work where your school, employer, or publisher prohibits it;
5. Your content stays yours
You own what you write in AIWritingPal, and you own the AI output you accept into your documents. We do not claim any ownership of your content.
To run the service, you give us a limited licence to store, process, and display your content, only so we can provide AIWritingPal to you. This includes sending the relevant text to our AI provider when you use Blue Pencil or a template, as described in our Privacy Policy. We do not use your documents to train AI models. The licence ends when you delete the content or your account, apart from the time it takes to clear it from backups.
You are responsible for making sure you have the rights to the content you bring into AIWritingPal.
6. AI output
Blue Pencil and templates are tools, not authorities. Their output can be inaccurate, incomplete, or unsuitable for your purpose, and similar requests from different users can produce similar results. Review every suggestion before you rely on it or publish it. You are responsible for the final text and how you use it.
7. Plans and billing
- Free plan: includes a one-time Blue Pencil allowance. It does not reset.
- Pro plan: paid monthly or yearly through Stripe. Your subscription renews automatically at the end of each period until you cancel.
- Cancelling: you can cancel at any time in account settings. You keep Pro access until the end of the period you have paid for, and you will not be charged again.
- Price changes: we may change prices. Any change to your renewal price takes effect only after we give you advance notice, so you have time to cancel.
8. Refunds
We do not give prorated refunds for partly used periods, except where the law requires it. If something went wrong with a charge — for example, you were billed by mistake or could not use the service — contact us within 14 days of the charge at [email protected] and we will look into it.
9. Changes to the service
We keep improving AIWritingPal, so features may change, and some may be removed. The service may occasionally be unavailable for maintenance or for reasons outside our control. If we decide to discontinue AIWritingPal entirely, we will give you reasonable notice first and a chance to export your documents.
10. Suspension and termination
You can stop using AIWritingPal and delete your account at any time in account settings.
We may suspend or close an account that violates these terms, puts other users or the service at risk, or where the law requires us to. Where it is reasonable, we will tell you why and give you a chance to export your documents. The sections on your content, disclaimers, limitation of liability, indemnity, and governing law continue to apply after your account ends.
11. Disclaimers
AIWritingPal is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the service will be uninterrupted or error-free, or that AI output will be accurate. Keep your own copies of important work.
12. Limitation of liability
To the fullest extent the law allows, NEXLY LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of AIWritingPal.
Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim, or US$50 if you have not paid us anything. Some places do not allow these limits, so they may not all apply to you.
13. Indemnity
If someone brings a claim against us because of content you created or because you broke these terms or the law, you agree to cover our reasonable losses and costs arising from that claim.
14. Governing law
These terms are governed by the laws of the United States and the state in which NEXLY LLC is organized. If you live somewhere that gives you consumer protections these terms cannot override, those protections still apply.
15. Changes to these terms
We may update these terms from time to time. We will post the new version here and change the date at the top. If a change is material, we will tell you by email or with a notice in the app before it takes effect. If you keep using AIWritingPal after that, you accept the updated terms.
